In connection to the adoption of Regulation (EU) 679/2016/EU of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (the “General Data Protection Regulation”), and the Slovak Act No. 18/2018 Coll. on Personal Data Protection, BULK TRANSSHIPMENT SLOVAKIA, a.s. publishes information about the processing of the personal data of data subjects in connection to the provision of services pertaining to iron ore reloading from broad-gauge (BG) wagons to normal-gauge (NG) wagons, the defrosting of iron ore in broad-gauge (BG) wagons, the cleaning of wagons, and providing railroad cargo transport services.

Purpose of Personal Data Processing

BULK TRANSSHIPMENT SLOVAKIA, a.s. is only processing the personal data required to ensure the due operation of the company and the provision of quality service to customers in the field of iron ore reloading from broad-gauge (BG) wagons to normal-gauge (NG) wagons, the defrosting of iron ore in broad-gauge (BG) wagons, the cleaning of wagons, and railroad cargo transport, to create good working conditions for its employees, to comply with the statutory obligations, and to protect its own legitimate interests.

Legal Bases of Personal Data Processing

When processing personal data, BULK TRANSSHIPMENT SLOVAKIA, a.s. proceeds in line with the current Act No. 18/2018 Coll. on Personal Data Protection and on the change and amendment of certain laws (hereinafter as the “Personal Data Protection Act”) and Regulation (EU) 679/2016/EU of the European Parliament and of the Council (hereinafter as “GDPR”).

The legal bases of the personal data processing shall be:

1. Special legislation, in particular: the Social Insurance Act, the Labour Code, accounting and wage regulations, the Commercial Code, the Civil Code, the Trade Law, and the Occupational Safety and Health Act.
2. The consent of the data subject to the processing of his or her personal data, depending on the purpose of the personal data processing:
3. Performance of a contract to which the data subject is a party
4. Processing of personal data to protect the life, health or property of the data subject
5. Legitimate interest of BULK TRANSSHIPMENT SLOVAKIA, a.s.

Your personal data is not transferred to other information systems and is only stored at BULK TRANSSHIPMENT SLOVAKIA, a.s.

Data Subject’s Consent

BULK TRANSSHIPMENT SLOVAKIA, a.s. obtains the data subject’s consent freely, without duress and without the threat of refusing a contractual relationship, the provision of services or the performance of obligations which the Controller is obliged to provide pursuant to the legally binding acts of the European Union, international treaty by which the Slovak Republic is bound, and pursuant to the law. The data subject may withdraw his or her consent at any time. 

BULK TRANSSHIPMENT SLOVAKIA, a.s. respects the privacy of individuals and treats all provided personal data as confidential.

Terms and Manner of Personal Data Processing

BULK TRANSSHIPMENT SLOVAKIA, a.s. processes the personal data of data subjects in its information systems using both automated and non-automated means of processing. BULK TRANSSHIPMENT SLOVAKIA, a.s. does not publish the processed personal data, except where this is required by special legislation or a decision made by a court or other state authority.

BULK TRANSSHIPMENT SLOVAKIA, a.s. shall not process the personal data of data subjects without their explicit consent or another legal basis for purposes other and within a scope larger than specified in this document. Personal data shall not be the subject of automated individual decision-making and profiling.

Period of Personal Data Retention

The period of personal data retention was set according to the purpose of processing the personal data and in line with the requirements of special legislation. Specific retention periods are defined by the internal filing plan prepared in compliance with the Act on Archives and Registries.

BULK TRANSSHIPMENT SLOVAKIA, a.s. shall liquidate in the prescribed manner only personal data, the retention period of which has elapsed. BULK TRANSSHIPMENT SLOVAKIA, a.s. must ensure that the personal data of data subjects is processed in a way enabling the identification of the data subjects during a period not longer than is necessary to achieve the purpose of the processing. BULK TRANSSHIPMENT SLOVAKIA, a.s. shall not transfer the personal data to any third countries or international institutions.

Rights of the Data Subject Related to the Processing of His or Her Personal Data

The data subject has the right to request from BULK TRANSSHIPMENT SLOVAKIA, a.s. access to the processed personal data at any time. He or she also has the right to the erasure of personal data, the right to the rectification of incorrect or incomplete personal data, the right to limit the processing, the right to object to profiling and automated decision-making, and the right to data portability. 

If the data subject suspects that his or her personal data is being processed without authorisation, he or she may file a request to start proceedings with regard to personal data protection with the Slovak Office for Personal Data Protection, registered office Hraničná 12, 820 07 Bratislava 27, or he or she may contact the Office using its website: www.dataprotection.gov.sk.

Security

BULK TRANSSHIPMENT SLOVAKIA, a.s. uses suitable technical and organisational measures to help protect all personal data from accidental or  intentional tampering, loss, destruction or unauthorised access. This also applies to all purchased external services.
